شروط خدمة منصة مكّن

باستخدامك موقع https://mken.live أو أي نطاق فرعي (مثل *.mken.live) أو بتسجيل الدخول — بما في ذلك عبر حساب Google — فإنك توافق على هذه الشروط وعلى سياسة الخصوصية. إذا كنت تستخدم المنصة نيابةً عن منشأة، فإنك تقرّ بأنك مخوّل بإلزام تلك المنشأة.

1. الخدمة

مكّن منصة تقنية لتقديم مواقع للأعمال، إدارة الحجوزات والطلبات، الفوترة الإلكترونية، واتساب CRM، وربط أدوات Google (مثل الملف التجاري والإعلانات) حسب الباقة المفعّلة. قد تتغيّر الميزات أو تُضاف حدود استخدام حسب الاشتراك.

2. الحساب والمصادقة

• يجب أن تكون البيانات صحيحة ومحدّثة، وأن يكون عمرك 18 عاماً فأكثر.
• أنت مسؤول عن سرية بيانات الدخول وعن النشاط الصادر من حسابك.
• عند اختيار «الدخول بحساب Google»، نستخدم بيانات Google فقط للمصادقة وإنشاء الحساب كما هو موضّح في سياسة الخصوصية.
• يجوز لنا تعليق أو إنهاء حساب يُستخدم بشكل مخالف أو يهدد أمن المنصة.

3. ربط خدمات Google

ربط Google Business Profile أو Google Ads اختياري ويتطلب موافقتك الصريحة في شاشة موافقة Google. أنت تصرّح لمكّن بالوصول إلى البيانات ضمن الصلاحيات التي وافقت عليها فقط، لإدارة ملفك أو حملاتك نيابةً عنك. تبقى مالكاً لحساب Google ولبيانات نشاطك. يمكنك إلغاء الربط في أي وقت من لوحة مكّن أو من إعدادات حساب Google. مكّن ليست شركة Google ولا تمثّل Google.

4. محتوى العميل ومواقع المستأجرين

تبقى مالكاً للمحتوى الذي ترفعه (نصوص، صور، بيانات نشاط). تمنح مكّن ترخيصاً غير حصري لعرض هذا المحتوى وتشغيل الخدمة (بما في ذلك النطاقات الفرعية والنطاقات المخصصة). تلتزم بعدم رفع محتوى غير نظامي أو منتهك لحقوق الغير، وبأنك مخوّل بنشر بيانات النشاط التجاري التي تدخلها.

5. التجربة والاشتراك والمدفوعات

قد تُتاح فترة تجربة محدودة. بعد انتهائها قد تُقيَّد ميزات مدفوعة أو يتحول الحساب حسب الباقة. الأسعار تُعرض بالريال السعودي ما لم يُذكر خلاف ذلك، وقد تشمل ضريبة القيمة المضافة وفق الأنظمة. تُعالَج المدفوعات عبر مزوّد دفع مرخّص. الرسوم المدفوعة غير قابلة للاسترداد إلا إذا نصّ عرض مكتوب على خلاف ذلك أو ألزم النظام بذلك.

6. الاستخدام المقبول

يُحظر: إساءة استخدام واجهات البرمجة، محاولة اختراق المنصة، إرسال رسائل عشوائية عبر واتساب أو البريد، انتحال صفة الغير، أو استخدام بيانات Google أو بيانات العملاء بما يخالف موافقة المستخدم أو أنظمة المملكة. أنت المسؤول عن امتثال رسائلك لأنظمة الاتصالات والتجارة الإلكترونية.

7. إخلاء المسؤولية وحدود الضمان

تُقدَّم الخدمة «كما هي». لا نضمن تصديراً دائماً على خرائط Google أو نتائج إعلانية معيّنة أو خلو الخدمة من الانقطاع؛ ذلك يعتمد على أطراف ثالثة (Google، واتساب، شبكة الاتصال) وعلى اكتمال بياناتك. إلى أقصى حد يسمح به نظام المملكة، لا تتحمل مكّن مسؤولية أضرار غير مباشرة أو فوات منفعة ناشئة عن استخدام المنصة أو توقفها.

8. الملكية الفكرية

اسم مكّن وشعاره وواجهة المنصة والكود ملك لمشغّل المنصة. لا يجوز نسخ المنصة أو إعادة بيعها كخدمة منافسة دون إذن مكتوب.

9. إنهاء الخدمة

يمكنك التوقف عن الاستخدام وحذف الحساب وفق سياسة الخصوصية. يجوز لنا إنهاء الوصول عند الإخلال الجوهري بهذه الشروط أو عند عدم سداد المستحقات. بعد الإنهاء نتوقف عن استخدام رموز Google ونحذف البيانات التشغيلية وفق سياسة الخصوصية والالتزامات النظامية.

10. القانون والاختصاص

تخضع هذه الشروط لأنظمة المملكة العربية السعودية. يُسعى لحل النزاع ودياً أولاً، ثم تكون الجهة القضائية المختصة في المملكة هي صاحبة الاختصاص.

Mken Terms of Service

By using https://mken.live, any subdomain (such as *.mken.live), or by signing in — including with Google — you agree to these Terms and to the Privacy Policy. If you use the platform on behalf of a business, you represent that you are authorized to bind that business.

1. The service

Mken provides business websites, booking and orders, e-invoicing, WhatsApp CRM, and optional Google tools (Business Profile and Ads) according to the active plan. Features and usage limits may change with the plan.

2. Accounts and authentication

• You must provide accurate information and be at least 18 years old.
• You are responsible for account credentials and for activity under your account.
• If you choose “Sign in with Google”, we use Google data only for authentication and account creation, as described in the Privacy Policy.
• We may suspend or terminate an account used in violation of these Terms or in a way that threatens platform security.

3. Connecting Google services

Connecting Google Business Profile or Google Ads is optional and requires your explicit consent on Google’s OAuth screen. You authorize Mken to access data only within the scopes you approve, to manage your listing or campaigns on your behalf. You remain the owner of your Google account and business data. You may disconnect at any time in Mken or in your Google Account settings. Mken is not Google and does not represent Google.

4. Customer content and tenant sites

You retain ownership of content you upload (text, images, business data). You grant Mken a non-exclusive licence to host and display that content to operate the service (including subdomains and custom domains). You must not upload unlawful content or content that infringes others’ rights, and you must be authorized to publish the business information you enter.

5. Trials, subscriptions, and payments

A limited trial may be offered. After it ends, paid features may be restricted or the account may convert according to the plan. Prices are in Saudi riyals unless stated otherwise and may include VAT. Payments are processed by a licensed payment provider. Fees are non-refundable unless a written offer states otherwise or applicable law requires a refund.

6. Acceptable use

You must not abuse APIs, attempt to compromise the platform, send spam via WhatsApp or email, impersonate others, or use Google or customer data beyond user consent or Saudi law. You are responsible for the legality of your own messages under communications and e-commerce rules.

7. Disclaimers

The service is provided “as is”. We do not guarantee permanent ranking on Google Maps, specific ad results, or uninterrupted availability; those depend on third parties (Google, WhatsApp, networks) and on the completeness of your data. To the maximum extent permitted under Saudi law, Mken is not liable for indirect damages or lost profits arising from use or interruption of the platform.

8. Intellectual property

The Mken name, logo, interface, and software are owned by the platform operator. You may not copy or resell the platform as a competing service without written permission.

9. Termination

You may stop using the service and request account deletion under the Privacy Policy. We may terminate access for material breach or non-payment. After termination we stop using Google tokens and delete operational data as described in the Privacy Policy and legal retention duties.

10. Governing law

These Terms are governed by the laws of the Kingdom of Saudi Arabia. Parties will first attempt an amicable resolution; competent Saudi courts then have jurisdiction.
